Types of California alimony

There are two main types of spousal support in California:

Temporary spousal support

When a spouse needs financial help before finalization of a divorce, they can seek temporary spousal support. This type of alimony helps the spouse meet their financial needs while their divorce is still pending. The amount is typically calculated by using a standard formula such as the Santa Clara County formula.

Permanent spousal support

A spouse can also seek permanent spousal support, where the goal is to ensure that the spouse is able to maintain the same standard of living enjoyed during the marriage. Some of the key factors considered when awarding permanent spousal support include the following:

  • Duration of the marriage
  • Age, health, and needs of each party
  • Earning capacity of each party and their ability to pay
  • The ability of the party who receives support to find employment without interfering with the interests and well-being of children
  • Supported spouse’s marketable skills and job market
  • Respective levels of education
  • Any domestic violence history

However, it is unusual for any judge to order genuinely permanent support unless the supported spouse has a physical or mental disability, or is too old to seek employment. Instead, the spouse seeking support must attempt to become self-supporting as the amount of support is gradually reduced over time.

Bear in mind that if the courts become involved, there is a significant amount of judicial leeway to make decisions about spousal support. In such cases, we will present your case in the best possible light – protecting your rights whether you are seeking alimony or being asked to pay spousal support.
